Terms & Conditions
Effective Date: January 3, 2025
Location: Peabody, Massachusetts
1. General Agreement
By enrolling or participating in any class, lesson, event, or program offered by Shorin-Ryu Temple (“the Dojo,” “we,” “our”), you acknowledge that you have read, understood, and agree to these Terms and Conditions. These terms are governed by the laws of the Commonwealth of Massachusetts.
2. Code of Conduct
- All students, parents, and visitors must conduct themselves respectfully toward instructors, staff, and fellow participants.
- Students must follow all safety rules and dojo etiquette.
- Disruptive, disrespectful, or unsafe behavior may result in suspension or termination of membership.
- Proper attire (clean uniform, belt, protective gear) and punctuality are required for participation.
- Parents and guardians must ensure that minors follow these standards.
3. Assumption of Risk and Liability Waiver
Martial arts training involves physical exertion, contact, and risk of injury. By participating in any activity at the Dojo, you acknowledge and voluntarily assume all risks — including but not limited to sprains, strains, fractures, concussions, or other injuries.
To the fullest extent permitted by Massachusetts law, you agree to waive, release, and hold harmless Shorin-Ryu Temple, its owners, instructors, employees, agents, and affiliates from any and all liability, claims, or causes of action arising out of participation, except in cases of gross negligence or intentional misconduct.
This waiver complies with Massachusetts General Laws (M.G.L. c.231 §85) regarding comparative negligence and does not release liability for intentional or reckless conduct.
4. Participation by Minors
For students under the age of 18, a parent or legal guardian must sign a written consent and waiver before participation. The guardian acknowledges responsibility for the minor’s behavior, safety, and adherence to all rules while on dojo premises or during dojo-sponsored events.
5. Health and Medical Fitness
Participants must be physically fit and cleared by a physician to engage in martial arts activity. Any injuries, medical conditions, or limitations must be disclosed to the Dojo prior to participation. In case of emergency, you authorize the Dojo to obtain necessary medical care and agree to bear all related costs.
6. Membership, Fees, and Refunds
- All payments, tuition, and membership fees are non-refundable, except where required by Massachusetts consumer protection laws (M.G.L. c.93A).
- Missed classes do not qualify for refunds or credits.
- The Dojo may modify class schedules, instructors, or pricing with reasonable notice.
- Memberships may be terminated for non-payment or violation of these terms.
7. Property and Personal Belongings
The Dojo is not responsible for lost, stolen, or damaged personal property on the premises.
8. Media and Photography Release
By participating, you grant Shorin-Ryu Temple permission to photograph, film, or record classes and events for marketing or educational purposes. If you prefer not to appear in media, you may opt out by providing written notice to the Dojo.
9. Amendments and Updates
The Dojo reserves the right to update these Terms and Conditions at any time. Any changes will be posted on our website or at the front desk. Continued participation after such updates constitutes acceptance of the revised terms.
